Staff Correspondent : The Supreme Court on Tuesday lifted the ban on legal practice by retired High Court judges in the Appellate Division and their service in the quasi-judicial bodies.
A seven-member bench of the Appellate Division headed by Justice SK Sinha issued the order by modifying its judgment on Fifth Amendment following a petition filed by the government.
The Supreme Court earlier in its verdict restored article 99 (2) of the 1972 constitution barring retired HC judges from legal practice in Appellate Division and quasi-judicial bodies.
Talking to reporters, Attorney General Mahbubey Alam said from now on retired judges can practise in the Appellate
Division and hold posts in judicial or quasi-judicial bodies.
The Attorney General said the Appellate Division earlier condoned some of the decisions which were taken and legalised by military governments through the Fifth Amendment.
